When you place an order from the treasure chest you are subject to the conditions set out below. By submitting an order you agree and accept to be bound by these conditions. These conditions are in addition to your statutory rights as a consumer and shall govern the contract to the exclusion of any other terms and conditions.
The Sale - The Customer ("you") will place an order for goods (minimum sale value £5.00) by submitting a completed order form on the website. We will confirm acceptance of your order by email and will supply the goods to you in accordance with the details on your order form. Subject to your statutory rights (as defined under the Unfair Contract Terms Act 1977) we reserve the right to refuse to accept or supply orders.
The Order - In submitting an order for the goods you acknowledge that all the information provided relating to the goods is supplied in good faith and in no way is intended to mislead.
Price and Delivery Charges - The price of the goods and conditions governing this contract shall be the price and conditions quoted on the website on the date of acceptance of the order by us. For orders valued greater than £5.00 the price of the goods includes delivery within the UK by the Royal Mail Recorded Delivery Service. An optional chargeable service is available to select Special Next Day Delivery guaranteed for a nominal charge, this is recommended if your delivery is urgent.
Payment Terms - Payment is accepted by us through PayPal. Any credit or debit cards accepted by PayPal can be used. Upon providing your credit/debit card details, you represent, warrant and undertake that the information contained in the order is true and accurate and that you are duly authorised to use the card and authorise PayPal to deduct payment from the credit/debit card account as payment in full for the price of the goods.
Despatch and Delivery - Every reasonable effort will be made by us to ensure the goods ordered are despatched to the place set out in the order form within 1 working day of the acceptance of the order. Any dates quoted for delivery of the goods are approximate only and we shall not be liable for any reasonable delay in delivery of the goods however caused, especially if that delay was due to any cause or circumstances beyond our reasonable control. Delivery of the goods shall be performed by the Royal Mail (a third party). We shall not be liable for late delivery unless we have acted negligently. It is your responsibility to provide adequate delivery instructions and take appropriate action to be able to accept delivery. We shall use all reasonable endeavours to deliver the goods.
Risk and Ownership - Title of the goods shall not pass to you ("the customer") until we have received payment in full with cleared funds for the price of the goods.
Warranties or liabilities - Subject to the conditions set out below we warrant that all goods will correspond with the order at the despatch date and will be free from defects on delivery. If there is a problem with the goods please advise us by email immediately and in any case not later than 14 working days from the delivery date or (where the defect was not apparent on reasonable inspection) within a reasonable time from the date of discovery of the defect. If delivery is not refused, and you do not notify us accordingly, the customer shall not be entitled to reject the goods and at our discretion we shall have no liability for such defect or failure, and the customer shall be bound to pay the price as if the goods had been delivered in accordance with the contract. Our liability for breach of any express or implied term of this contract or due to our negligence shall be limited to the reasonable cost of remedying any defect in the goods or other matter constituting a breach and in no circumstances shall our liability exceed the Total Price paid by the customer. If a dispute does occur all parties to the contract shall negotiate in good faith and agree upon alternative arrangements as may be fair and reasonable to reach an acceptable outcome.
